On May 14, 2025, Poland introduced a new draft Law on Crypto-Assets (Projekt ustawy o rynku kryptoaktywów) implementing the provisions of the EU MiCA Regulation (Markets in Crypto-Assets). This act establishes unified rules for the regulation of crypto-assets and the operation of participants in the digital finance market.

The document is highly anticipated, as many crypto projects have chosen Poland as their jurisdiction of operation. A key question arises: how will the new legislation impact current and prospective participants in Poland’s crypto-asset market?

Commentary by crypto lawyer Vlad Plakhotniuk:

What we would like to note separately: the law provides for a transitional period of 9 months for those who applied within 3 months after the law came into force and 4 months for those who decided not to get CASP. These conditions will only apply to companies that have filed a “complete application”.

This is where the difficulties may arise, as the law itself does not specify what this “ complete application” means, of course, everyone is hoping for a clarification of this term, as the law is currently under active consideration and is still being amended, but for now it is worth relying on MiCA in this matter. MiCA defines a “complete application” as one that complies with the requirements set out in Article 63.
